    These Terms & Conditions explain the rules, responsibilities, and limitations that apply when you use our website, purchase a service, submit a form, or work with Simply DSGN.

    1. Acceptance of Terms

    By using this website, submitting a form, purchasing a service, or working with Simply DSGN, the customer agrees to these Terms & Conditions.

    2. Services Provided

    Simply DSGN provides services that may include:

    • Monthly website plans
    • One-time website design projects
    • Website hosting and maintenance
    • Domain connection assistance
    • Basic on-page SEO setup
    • CRM and lead capture tools
    • Forms, calendars, and automations
    • Digital marketing services
    • Social media marketing
    • Paid advertising support
    • Content creation
    • Google setup or visibility-related services
    • Google Business Profile optimization
    • Logo concept add-ons
    • Other related digital services

    The exact scope of work depends on the plan, proposal, checkout item, invoice, or agreement selected by the customer.

    3. Monthly Website Plans

    Monthly website plans are subscription-based services.

    • Monthly website plans are billed on a recurring monthly basis.
    • Hosting and SSL security are included while the subscription remains active.
    • The customer is responsible for providing accurate business information, images, content, domain access, and any requested materials.
    • Website build timelines depend on the customer providing the required information and approvals.
    • Monthly plans may include limited support or minor edits depending on the plan selected.
    • Larger edits, redesigns, new pages, advanced functionality, or work outside the plan may require an additional fee.

    4. One-Time Website Projects

    One-time website projects are traditional website builds with a one-time project fee.

    • Scope, pricing, and deliverables are based on the selected package, invoice, proposal, or written agreement.
    • Additional revisions, pages, integrations, or functionality outside the agreed scope may require additional payment.
    • Project timelines depend on timely client feedback, approvals, and content delivery.

    5. Payments and Billing

    Payments may be processed through third-party payment processors such as Stripe.

    • Customers agree to pay all fees shown at checkout, on invoices, or in written agreements.
    • Subscription payments are billed automatically unless canceled according to the cancellation terms.
    • Add-ons, setup fees, extra pages, logo concept packs, Google setup, Google Business Profile optimization, or other one-time services may be charged separately.
    • Failed payments may result in paused services, delayed work, or temporary suspension of the website or account.
    • Simply DSGN does not store full credit card numbers directly.

    6. Cancellations

    • Monthly website plans may be canceled by contacting Simply DSGN.
    • Cancellation stops future billing but does not automatically refund previous payments.
    • If a monthly website subscription is canceled, the website, hosting, support, and related services may be paused, removed, or taken offline.
    • Any unpaid balances must be paid before final access, transfer, or additional work is provided.
    • If a customer wants to move, export, or buy out a website built under a monthly plan, a separate buyout or migration fee may apply if offered.

    7. Website Ownership and Access

    • For monthly website plans, Simply DSGN may retain ownership/control of the website build, design structure, templates, hosting setup, and related system assets while the subscription is active.
    • Customers retain ownership of their own business name, logo, written content, photos, domain, and brand assets provided by them.
    • Websites hosted under monthly plans remain active only while the subscription is active.
    • If a customer wants full ownership or transfer rights, this must be arranged separately in writing.
    • Some platforms may not allow full export or migration without rebuilding the website elsewhere.

    8. Domains

    • Domain registration is not included unless clearly stated.
    • Customers are responsible for owning, renewing, and maintaining their domain name.
    • Simply DSGN may assist with domain connection, DNS setup, or launch support.
    • Simply DSGN is not responsible for expired domains, domain renewal failures, incorrect DNS changes made by third parties, or loss of domain access.

    9. Hosting, SSL, and Technical Services

    • Hosting and SSL may be included with certain website plans while the plan remains active.
    • Simply DSGN will make reasonable efforts to keep websites live and functioning.
    • No platform, hosting environment, third-party tool, or integration can be guaranteed to be uninterrupted, error-free, or available at all times.
    • Third-party outages, DNS issues, payment failures, platform changes, or client-made changes may affect website availability.

    10. Client Responsibilities

    Customers are responsible for:

    • Providing accurate business information
    • Providing images, logos, content, and approvals when needed
    • Reviewing work and requesting revisions in a timely manner
    • Maintaining access to their domain registrar, email, Google accounts, and third-party platforms
    • Complying with laws and regulations related to their business, industry, website content, advertising, privacy, and communications
    • Making sure any provided images, logos, copy, or materials are legally allowed to be used

    11. Revisions, Edits, and Support

    • Included edits depend on the selected plan.
    • Minor edits may include simple text updates, image swaps, phone number changes, hour changes, or small content changes.
    • Major revisions, redesigns, new pages, new layouts, advanced functionality, custom integrations, or strategy work may require additional payment.
    • Support response times may vary depending on the plan and request type.

    12. Add-Ons and Optional Services

    Add-ons may include services such as:

    • Logo Concept Pack
    • Google Search Console / indexing setup
    • Google Business Profile optimization
    • Extra website pages
    • Custom widgets
    • CRM setup
    • Automations
    • AI chatbot setup
    • Additional design or marketing services

    Add-ons are billed separately and may have their own scope limitations.

    Logo Concept Pack: If a logo concept pack is purchased, Simply DSGN may provide multiple logo concept options for review. The customer selects one preferred concept for final delivery. Revisions are not included unless specifically stated.

    Google Setup: Google setup, indexing, Search Console, sitemap submission, or visibility-related services do not guarantee rankings, search placement, traffic, leads, or sales.

    Google Business Profile Optimization: Google Business Profile optimization does not guarantee rankings, map placement, calls, leads, or customer actions.

    13. No Guarantees

    Simply DSGN does not guarantee specific business results, search engine rankings, advertising results, lead volume, sales, revenue, approval by third-party platforms, or uninterrupted performance of third-party services.

    14. Third-Party Platforms and Tools

    Simply DSGN may use third-party platforms and tools such as:

    • Website builders
    • Hosting platforms
    • GoHighLevel / LeadConnector
    • Stripe
    • Google tools
    • Analytics platforms
    • Scheduling tools
    • Email and SMS providers
    • Social media platforms
    • Advertising platforms
    • Other software or service providers

    Simply DSGN is not responsible for outages, policy changes, account restrictions, billing changes, platform limitations, or service interruptions caused by third-party providers.

    15. Email, SMS, and Communication Consent

    By submitting forms, booking appointments, purchasing services, or providing contact information, customers agree that Simply DSGN may contact them by email, phone, or text message regarding their inquiry, account, project, service, appointments, or support requests.

    SMS Messaging Terms

    Simply DSGN provides website design, monthly website plans, digital marketing, CRM/lead tools, onboarding forms, client communications, and related digital services. By providing your phone number and opting in, you may receive non-marketing text messages from Simply DSGN related to your website inquiry, appointment reminders, onboarding, project updates, account notifications, service updates, and support communications.

    You can cancel the SMS service at any time. Just text "STOP" to 609-309-8777. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.     Carriers are not liable for delayed or undelivered messages.

    As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive message frequency may vary based on your inquiry, appointment, project, account, or service activity. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

    Age Requirement: You must be at least 18 years old or the age of majority in your jurisdiction to use our SMS messaging service. By opting in to receive SMS messages from Simply DSGN, you confirm that you meet this age requirement.

    Mobile opt-in information is not sold or shared with third parties or affiliates for marketing or promotional purposes.

    16. User Accounts and Client Dashboards

    • Some customers may receive access to a client dashboard, CRM, portal, or related account.
    • Customers are responsible for keeping login information secure.
    • Customers should not share access with unauthorized users.
    • Simply DSGN may limit, suspend, or remove access if needed for security, non-payment, misuse, or cancellation.

    17. Intellectual Property

    • Simply DSGN owns its processes, templates, designs, systems, layouts, strategies, frameworks, and internal materials unless otherwise agreed in writing.
    • Customers may not copy, resell, redistribute, or claim ownership of Simply DSGN's templates, systems, or proprietary materials.
    • Customer-provided assets remain the property of the customer or their rightful owner.

    18. Limitation of Liability

    Simply DSGN is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost leads, lost data, business interruption, or issues caused by third-party platforms.

    19. Refund Policy

    • Payments for completed work, active subscriptions, setup fees, add-ons, and digital services are generally non-refundable unless otherwise stated in writing.
    • Refund requests may be reviewed on a case-by-case basis.
    • Canceling a monthly subscription stops future billing but does not automatically refund previous payments.

    20. Changes to Services or Terms

    Simply DSGN may update services, pricing, features, plans, policies, or these Terms & Conditions from time to time. Updates will be posted on this page with a revised "Last Updated" date.
